The following conditions apply to the provision and use of mobile applications by MLAP GmbH („MLAP“), Meitnerstr. 9, 70563 Stuttgart - subject to deviating and/or supplementary regulations in individual cases:
By installing and using an application offered by MLAP, the user accepts the following terms of use in their currently valid version. Unless otherwise agreed, these conditions also apply to future updates or new versions of the software.
Medion grants the user a simple, non-transferable right to use the software. The right of use is subject to the conditions set out in these terms of use. Additional terms of use or restrictions may result from the end user terms and conditions of the respective app store through which the software is offered.
MLAP may also transmit notifications to the user via electronic communication services (e.g. push messages, e-mail, SMS) as part of the execution of the application. These messages may contain general information (e.g. about available updates) as well as user-specific notifications (e.g. warnings, reminders, recommendations).
The software may only be used by persons age 16 or above. A parent or guardian's permission is required until the age of 18 to use the app and agree to the Terms of Use.
In order to use the software, the user requires a terminal device that meets the respective system and compatibility requirements for the corresponding software version. Compliance with the technical requirements is the sole responsibility of the user.
The app can automatically download and install software updates to fix possible program errors (so-called patches or bug fixes). The functionality and the scope of services are usually not changed by such updates.
The statutory warranty conditions apply with the provision that the app has been tested and comprises the specified functions. However, no guarantee can be given for the suitability of the app with regard to the use intended by the user. The liability for damages resulting from any harm to life, body or health as well as due to the violation of essential contractual obligations is not limited, nor is the liability in accordance with the Product Liability Act. In all other cases, the obligation to pay damages is also limited to intent and gross negligence.
The law of the Federal Republic of Germany shall apply. MLAP reserves the right to change these Terms of Use if this is necessary for legitimate reasons (e.g. changes in statutory framework or case law). In this case MLAP will inform the user in good time about the change and will request the user's consent. Further use of the app may be made subject to user’s approval of the amended terms. Should any individual provision(s) of these terms of use be or become invalid or void, this shall not affect the validity of the remaining provisions. The invalid or void provision shall be replaced by a provision which best matches the economic purpose of the invalid or void provision in a valid manner.
